  • Research summary

Section 136 of the 1983 Mental Health Act allows a Police Constable to detain a person who is in a public place, appears to be suffering from a mental illness and is in immediate need of care or control. The Police constable may remove that person to a place of safety if he thinks this is necessary for the protection of the public and/or in the best interests of that person.

This research aims to investigate the impact on affected individuals of being detained under section 136 of the Mental Health Act, with particular focus on persons with a single experience of being detained and taken to a place of safety who are subsequently released after a formal assessment by mental health professionals.

Existing research on section 136 has investigated aspects of admission rates, the experiences of persons detained and levels of knowledge among professionals (Borschmann, et al 2010; Riley, et al 2011) but no research has been done to investigate the physical and psychological impact of section 136 detention on those who are detained and assessed but the subsequently released.
