General guidance relating to adults unable to consent for themselves

It is important to note that the Mental Capacity Act 2005 and the Adults with Incapacity (Scotland) Act 2000 do not apply to Clinical Trials of Investigational Medicinal Products. The arrangements for adults unable to consent for themselves are covered specifically in the legislation for clinical trials.
